South Korea’s ruling Democratic Party of Korea on Monday unveiled its first draft of a judiciary reform plan, proposing to increase the number of Supreme Court justices from 14 to 26. If enacted, the reform would allow President Lee Jae Myung to appoint a majority of the bench by the end of his term.
한국의 집권 여당인 더불어민주당은 월요일 대법관 수를 14명에서 26명으로 늘리는 사법 개혁안의 첫 초안을 공개했다. 이 개혁안이 시행되면 이재명 대통령은 임기 말까지 재판관 과반수를 임명할 수 있게 된다.
According to the party, the new system is intended to take effect one year after enactment, with four new justices added each year over three years.
(민주)당에 따르면, 새 제도는 공포 1년 후부터 시행될 예정이며, 3년 동안 매년 4명의 새로운 판사가 추가될 예정이다.
Currently, the Supreme Court comprises 14 justices — 12 of whom were appointed under former President Yoon Suk Yeol between 2022 and 2024. But if the expansion is completed, only four of them will remain by the end of President Lee’s term in June 2030, making his appointees a clear majority on the bench. Each Supreme Court justice serves a six-year term.
현재 대법원은 14명의 대법관으로 구성되며, 그중 12명은 2022년부터 2024년까지 윤석열 전 대통령 재임 시절 임명됐다. 그러나 대법관 증원이 완료되면 2030년 6월 이 대통령 임기 종료 시점까지 4명만 남게 돼, 이 대통령이 임명한 대법관들이 재판부에서 확실한 과반수를 차지하게 된다. 각 대법관의 임기는 6년이다.
The plan also calls for diversifying the composition of the Supreme Court Justice Recommendation Committee, introducing a judicial performance evaluation system, expanding public access to lower court rulings, and adopting a pre-hearing procedure for search and seizure warrants.
또한 이 계획에는 대법원 판사 추천위원회의 구성 다양화, 사법 실적 평가 제도 도입, 하급 법원 판결에 대한 대중의 접근성 확대, 그리고 압수 수색 영장에 대한 심리 전 절차 채택의 내용이 담겨있다.
While the proposal does not include allowing the Constitutional Court to review Supreme Court judgments, Democratic Party leader Rep. Jung Chung-rae said the party leadership plans to introduce a separate bill on the issue.
이 제안에는 헌법재판소가 대법원 판결을 검토할 수 있도록 허용하는 내용이 포함돼있지 않지만, 민주당 대표 정청래 의원은 당 지도부가 이 문제에 대한 별도의 법안을 발의할 계획이라고 말했다.
“It’s necessary to allow the Constitutional Court to review court judgments in order to protect citizens’ rights and ensure proper constitutional remedies,” Jung said during a press conference at the National Assembly in Seoul.
정 대표는 서울 국회에서 열린 기자회견에서 "국민의 권리를 보호하고 적절한 헌법적 구제수단을 마련하기 위해서는 헌법재판소가 법원의 판결을 검토할 수 있도록 하는 것이 필요하다"고 말했다.
The judiciary reform draft was released a week after the National Assembly’s Legislation and Judiciary Committee — where the Democratic Party holds a majority of nine members, including the chair, Rep. Choo Mi-ae — grilled Supreme Court Chief Justice Jo Hee-de over allegations that he intentionally remanded a case through a full bench meeting in May ahead of the June 3 election. The case involved an election law violation by Lee Jae Myung, who was then the Democratic Party’s presidential candidate.
사법개혁안은 위원장인 추미애 의원을 포함해 민주당이 9명의 과반수를 차지하고 있는 국회 법제사법위원회가 조희대 대법원장이 6월 3일 대통령 선거를 앞두고 5월 전원합의체를 통해 고의로 사건을 환송했다는 의혹을 제기한 지 일주일 만에 발표됐다. 이 사건은 당시 민주당 대선 후보였던 이재명 대통령의 공직선거법 위반 (혐의)와 관련이 있다.
The Supreme Court's full bench requires the participation of at least two-thirds of all justices. Twelve justices, including Jo, joined the May session, with 10 — all appointed under the Yoon administration — voting to remand Lee’s case to a lower court.
대법원 전원합의체는 전체 대법관의 3분의 2 이상의 찬성을 요구한다. 조희대 대법원장을 포함한 12명의 대법관이 5월 회기에 참여했고, 윤석열 정부 시절 임명된 10명의 대법관은 이재명 대통령의 사건을 하급법원으로 환송하기로 결정했다.
